Terms of Service
These Terms of Service ("Terms") govern your access to and use of Humanoid, its affiliates, and its licensors ("we," "us," or "our"). By downloading, installing, or using the products and services, you ("User," "you," or "your") agree to comply with and be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
2. License to Use the App
We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App solely for personal, non-commercial purposes, in accordance with these Terms. You agree not to reverse engineer, decompile, or attempt to extract the source code of the applications. You also agree to not copy, modify, or distribute Humanoid products and services for any purpose other than as expressly permitted by these Terms. Finally, you agree, to use Humanoid products and services in a manner that violates any applicable law, regulation, or third-party rights.
3. User Accounts
To access certain features of Humanoid products and services, you need to create a user account. When registering, you agree to provide accurate, current, and complete information, maintain the confidentiality of your account credentials and notify us immediately if you suspect any unauthorized use of your account. You are responsible for all activities that occur under your account.
4. Health Data and Monitoring
Humanoid products and services are designed to track and monitor various health-related metrics, including but not limited to activity levels, heart rate, sleep patterns, and other wellness data ("Health Data"). You acknowledge and agree that Humanoid products and services are not intended to replace professional medical advice, diagnosis, or treatment. Also, you understand that the health data, suggestions and analysis provided through Humanoid products and services are for informational purposes only and should not be relied upon for making health-related decisions without consulting a qualified healthcare provider. You are responsible for ensuring the accuracy of the data you provide and for any health-related decisions made based on your use.
5. Privacy and Data Collection
Your use of Humanoid products and services is also governed by our privacy policy, which explains how we collect, use, and protect your personal information and health data. By using them, you consent to the practices described in our privacy policy.
6. Third-Party Services and Integration
The App may integrate with third-party services, such as fitness trackers, health platforms, or mobile devices ("Third-Party Services"). You acknowledge that we do not control or endorse third-party services and are not responsible for accuracy, availability, or performance of any third party device not brought and used by our team members. By linking Humanoid products and services with your suggested third-party services, you may be subject to additional terms and conditions imposed by those service providers. Humanoid products and services may collect data from third-party services, and you have the option to disconnect or disable these integrations at any time.
7. No Medical Advice
Humanoid products, services and content are for general informational purposes only. We do not provide medical advice, and nothing shown in our apps, platforms and documents should be construed as medical advice. Always consult with a qualified healthcare professional before making any health-related decisions or taking any actions based on the Health Data or any information provided by Humanoid products and services.
8. Disclaimers and Limitation of Liability
Humanoid products and services are provided "as is" and "as available," without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our products and services, including any errors or omissions in health data or the failure of our products and services to meet your expectations.
9. Indemnification
You agree to indemnify, defend, and hold harmless Humanoid, its officers, directors, employees, agents, and affiliates from any claims, losses, damages, liabilities, costs, or expenses (including attorneys' fees) arising out of or in connection with your use of the App, violation of these Terms, or any violation of applicable law.
10. Termination
We may suspend or terminate your access to Humanoid products and services at any time, without notice, for any reason, including if we believe you have violated these Terms. Upon termination, you must immediately cease using the App and delete any copies of the App from your device.
11. Modifications to the Terms
We reserve the right to modify, update, or change these Terms at any time. Any changes will be effective when we post the revised Terms in the App or on our website. Your continued use of the App after the changes are posted constitutes your acceptance of the updated Terms.
12. Governing Law and Dispute Resolution
These terms will be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising from or related to these Terms will be resolved through binding arbitration, conducted in Pune, under the rules of Indian Penal Code.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
14. Entire Agreement
These Terms, along with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and Humanoid regarding your use of the App and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.
